Agreement
These Terms of Use ("Terms") govern your use of ACT Test Prep 2026: Practice, developed by Hermes Digital. By downloading or using ACT Test Prep 2026: Practice, you agree to these Terms. If you disagree with any part, please do not use the app.
These Terms incorporate Apple's standard EULA by reference. In case of conflict, Apple's EULA takes precedence for matters covered therein. View Apple's Standard EULA.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use ACT Test Prep 2026: Practice for personal, non-commercial purposes. You may not:
- Copy, modify, or distribute the app or its content
- Reverse engineer or extract the source code
- Use the app for any unlawful purpose
- Remove or alter proprietary notices
Subscriptions & Payments
ACT Test Prep 2026: Practice offers auto-renewing subscriptions for premium features:
- Weekly: US$3.99/week
- Monthly: US$10.99/month
- Quarterly: US$21.99 every 3 months
Prices are in U.S. dollars for the United States storefront; the price shown in the app at purchase prevails in other storefronts.
Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
If a free trial is offered, any unused portion is forfeited when you purchase a subscription. You can manage or cancel subscriptions in your App Store account settings; canceling stops future renewals and you retain access until the end of the current period. We do not offer refunds for partial periods, except as required by law.
100% Refund Guarantee If You Don't Pass
In short: the ACT has no official pass/fail line; it reports a Composite score from 1 to 36. For this guarantee, "not passing" means an official ACT Composite score below 16. If you study with the app following the rules below, take the ACT and score below 16, we refund your subscription as described here. The guarantee is a commercial promise by Hermes Digital, not a prediction of results: the app is not affiliated with or endorsed by ACT, Inc., and no one can guarantee a test result.
1. Who is eligible
- Be a resident of the United States. Students under 18 take part through a parent or legal guardian, who files the claim on their behalf.
- Have a quarterly subscription. The weekly and monthly plans and the free trial period are not eligible.
- The subscription must be paid and uninterrupted from sign-up until test day. Any cancellation, billing failure or gap between periods ends eligibility.
- Have subscribed at least 90 days before your ACT test date.
- One Apple ID, on up to two of your own devices. Shared accounts are not eligible.
2. Minimum app use (preparation period)
The preparation period runs from the subscription date to the day before the test and must be at least 30 days long. During it, all of the following are required:
- Daily time: at least 1 hour 30 minutes of active study per day. Only time with a question session in progress counts — an idle app, locked screen or background time does not.
- Frequency: every day of the period, without exception. A single day without study ends eligibility.
- Practice tests: at least 1 full practice test per day in Mock Exam mode, started and finished the same day. Abandoned, restarted or unfinished tests do not count.
- Volume: at least 100 questions answered per day and 3,000 questions in total during the period.
- Performance: at least 8 practice tests per calendar month, and an average of 70% or more correct on your last 5 practice tests before the test.
- Coverage: questions answered in every section of the plan, with no section left at zero, and 100% of your personalized plan completed.
- Review: clear the missed-questions review queue at least once a week.
- Streak: end the preparation period with your study streak active since sign-up, with no break.
3. The test
- Have registered for and taken a national ACT test date (the full test with English, Math, Reading and Science), on the first test date after your subscription.
- Have received an official ACT Composite score below 16 on the score report issued by ACT, Inc.
- Not covered: absence, dismissal, cancelled or withheld scores, superscores, section retesting, state/district or school-day testing, or admission, scholarship or placement decisions by any college.
4. How to claim
- Email support@hermes.com.br with the subject "100% Guarantee" within 7 calendar days after your official scores are released. After that the right expires.
- Attach: full name; the Apple ID email used for the subscription; your ACT admission ticket; your official ACT score report showing your name and Composite score; and screenshots of the app's Stats tab.
- Reply within 7 calendar days to any request for additional information.
- Authorize us to check your usage records to verify the requirements.
5. How we verify
Usage requirements are verified from the records the app keeps on your device. We do not keep a copy of this data on our servers. If the history is lost — by uninstalling the app, switching devices without a backup, or using "Reset Progress" in Settings — compliance cannot be proven and the claim will be declined.
We also decline claims with signs of manipulation: changing the device clock, emulators, tap automation, jailbroken devices, or answer patterns incompatible with a human reading the questions.
6. What we refund
- The amount of the last charge of the quarterly subscription, and only that charge.
- If Apple has already refunded that charge, there is nothing further to refund.
- Refunds are processed by Apple, to the payment method of your Apple ID. Once your claim is approved, we request the refund and guide you to file it at reportaproblem.apple.com. Completion may take time according to Apple's and your bank's timelines.
- The guarantee can be used once per person, for a single ACT test date.
- Upon refund, the subscription ends and access to paid content stops.
7. Other conditions
- If your test date is cancelled, postponed or your scores are not released by ACT, Inc., the guarantee does not apply to that date.
- We may change or end this guarantee for new subscriptions at any time. Existing subscribers remain under the rules in force on their sign-up date — keep a copy of this page.
- This guarantee is an additional contractual benefit and does not replace or limit any rights you have under applicable consumer protection law.
Acceptable Use
- Do not violate applicable laws or regulations
- Do not infringe intellectual property rights
- Do not transmit harmful or malicious content
- Do not attempt unauthorized access to our systems
- Do not interfere with the app's operation
Disclaimer of Warranties
ACT Test Prep 2026: Practice is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Hermes Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ACT Test Prep 2026: Practice. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
Termination
We may suspend or terminate your access at our discretion if you violate these Terms. You may stop using the app at any time. To delete your data, contact support@hermes.com.br.
Governing Law
These Terms are governed by the laws of Brazil, without regard to conflict of law provisions, unless otherwise required by consumer protection law in your jurisdiction.
Changes to These Terms
We may update these Terms from time to time. Continued use of ACT Test Prep 2026: Practice after changes constitutes acceptance of the updated Terms.
